Terms & Conditions

The following Terms and Conditions constitute a legally binding agreement between Eighty-Eight Sports Institution, registered under Commercial Registry 4031288523, operating the Eighty-Eight gyms brand in Saudi Arabia (referred to as the "Service Provider"), and the "Service Requester," representing the customer seeking to subscribe to the gym membership at an Eighty-Eight branch.
By completing the payment, the Service Requester automatically agrees to and digitally signs off on the terms outlined in this membership agreement.

Definitions:

Service Provider:

Refers to Eighty-Eight Sports Institution, the proprietor of the Eighty-Eight brand, overseeing branches, Eighty-Eight website, and the mobile application.

Member / Customer:

An individual utilizing services from the Service Provider, subscribing to Eighty-Eight, and typically availing themselves of gym facilities.

Service Requester / User:

A customer subscribing to Eighty-Eight's membership packages through the mobile application, website, or branches for the offered service benefits and gym facilities access.

Use:

Encompasses logging into the Eighty-Eight website/mobile application and utilizing gym facilities to benefit from services provided by Eighty-Eight gym.

Service Requester Data:

Information collected for initiating, activating, and maintaining membership subscriptions, as well as for running various marketing campaigns through varied communication channels offered by Eighty-Eight.

Gym:

Any affiliated branch or facility of Institution in Saudi Arabia where members enjoy benefits as per this agreement.

Third Party:

An entity making direct payments for subscriptions, services, or any offerings approved by the Service Provider.

Applicable Law:

Refers to the laws enforced in the Kingdom of Saudi Arabia.

Database:

A collection of data maintained by the service provider for activating and renewing subscriptions and other legitimate business uses.

Content:

Data or documents recorded or submitted by the service requester on the Eighty-Eight website/mobile application or any of its branches.

Acceptable use:

Refers to utilizing the facilities, services, website, or mobile application in a manner that is reasonable and appropriate, ensuring no disturbance or inconvenience to others, maintaining operational harmony, and adhering to the prescribed usage guidelines and code of conduct set forth by the service provider.

Unacceptable use:

Refers to any usage or conduct that surpasses established norms and standards of respect, including but not limited to aggressive behavior, vandalism, persistent disturbance of others, or actions posing a threat to the safety of individuals or property. This encompasses all aspects of the facilities, services, Eighty-Eight website, and mobile application.

Policies:

Rules established by the service provider to regulate and govern all operational aspects, services, features, or benefits offered.

Provisions Regulating Use:

Service Provider's Rights:

Eighty-Eight institution retains the right to modify these terms and conditions. Such alterations become effective upon notifying the participant through authorized channels, including in-person communication, text messages, the call center, the mobile application, or email.

Service Requester Registration:

The Service Requester is permitted to register on the Eighty-Eight website or mobile application by providing all mandatory information and fully complying with the terms and conditions.

Information Accuracy:

The Service Requester agrees to accurately provide all required personal information on the Eighty-Eight website / application or at the branches, assuming responsibility for any inaccuracies.

Data Processing:

The Service Provider has the right to utilize and process given personal data of members / customers in accordance with the requirements of the Ministry of Interior.

Personal Information Update:

The Member agrees to promptly update any changes in personal information in their membership profile and Eighty-Eight platform to ensure data accuracy.

Usage Policy:

Service Provider's Rights:

Eighty-Eight reserves the right to suspend a member account for violations of membership terms and conditions, internal policies, traditional customs, and or regulations of the Kingdom of Saudi Arabia.

Service Requester Liability Obligations:

The Service Requester acknowledges the legal implications of providing incorrect, inaccurate, outdated, incomplete, or illegitimate information while using Eighty-Eight platforms or branches.

Termination of Use:

Eighty-Eight reserves the right to terminate, deactivate, or restrict access to a member's account at any time, without liability or explanation, in cases including but not limited to: 1. Using the subscription by someone other than the member. 2. Member misconduct, disturbing other members, or non-compliance with the regulations of the Kingdom of Saudi Arabia and the branch terms and conditions. 3. Member involvement in verbal or physical assault on any of the branch employees or members. 4. Promoting or selling goods or products within the branch. 5. Providing paid services related to personal training or any other services not included in the services provided by Eighty-Eight Institution / Eighty-Eight Gym. 6. Giving gifts (financial amounts or material gifts) to any of the trainers or branch employees. 7. Leaving the weight plats on the machines or dumbbells or weights on the floor after using without turning them back to its original place.

Children's Hospitality

The subscriber is prohibited from leaving a child in the children's hospitality section for more than two hours.
The club is committed to handing the child over to the security authorities in the event that the guardian leaves the club and leaves his child.
Bringing children's clothes and meals is a condition for registering the child.
The ages of children in hospitality are from 3 years to 6 years.
Children are received by parents only, with proof of identity.

Fees and Prices

Prices:

Listed on the Eighty-Eight Website/Mobile Application are in Saudi Riyals by default. Exchange rates for payments in different currencies will be applied as per the processing bank on the purchase date, along with a service charge through the electronic payment gateway.

Eighty-Eight Subscription Packages

One Month:

450 SAR (inc VAT)

Three Months:

1500 SAR (inc VAT)

Six Months:

2300 SAR (inc VAT)

Twelve Months:

3300 SAR (inc VAT)

Kids Garden

300 SAR for One Month.
20 SAR for One Day Access.

Kids from 7 to 12 years

The membership fee for children aged 7 to 12 is 350 SAR per month (3 sessions per week).
Parents are required to wait for their children and pick them up immediately after the session ends, as there is no designated waiting area inside the club.

Injuries Rehabilitation

250 SAR per session.
100 SAR for check-up/examination.

Inbody Measurements Device Fee

25 SAR for each measurement.

Payment Terms

Joining Fee:

A joining fee is applicable to all new memberships. The Service Provider retains discretion to include or waive this fee during promotions, renewals, re-joining processes, or discounts.

Membership Package Upgrade:

Members may upgrade their membership by paying an additional fee within 14 days of the initial payment. Requests for upgrades after this period will not be accepted. If a member purchases a discounted package, they cannot upgrade to another offer — they can only upgrade at the original price.

Installment Payments:

If installment options are available, payments may be processed through a third party. Members are required to make all installment payments to the third party. Any discrepancies must be addressed directly by the service requester with the third party. The service provider may not be held accountable for any discrepancies or liability resulting from services rendered through a third party.

Membership Renewal:

Expired memberships renewed 30 days after expiration require a payment of 50 SAR unless eligible for an upgrade, in which case the joining fee can be waived.

Payment Channels:

All service fees are to be paid through available electronic payment channels or any activated payment services at the time of subscription, either through branches, online, mobile application, or authorized third parties.

Gym Access Rules

Access Control:

Access into branches is closely monitored through the access control system. Proof of identification may be requested as needed.

Unauthorized Access Investigation:

Suspected unauthorized gym access or use may result in an investigation during which the membership may be suspended until all investigations are completed.

Access Methods:

Gym access is granted solely through the provided access control system, enabled and active only through the dedicated Eighty-Eight mobile app.

Sharing Membership Access:

Sharing access methods is prohibited and may lead to membership termination.

Unauthorized Entry and Assisting Non-Members:

Eighty-Eight strictly prohibits attempting to enter the gym from unauthorized locations or assisting non-members in gaining access. Violations grant the service provider authority to terminate membership without compensation or refunds.

Membership Specifications

Individuals under the age of 18:

Must complete and submit a Guardian Consent Form.

Members aged 12–15:

Must always be accompanied by a parent or guardian member, or register with a personal trainer while using the facilities.

Minimum age for membership:

12 years old.

Kids Garden:

3 to 6 years old.

Kids (7–12 years):

7 to 12 years old.

Access Privileges:

Membership type dictates access privileges, encompassing various benefits such as hours of operation, access to multiple gyms/branches, membership freezing options, service discounts, participation in activities, special offers, and benefits extended by external partners.

Activation and Expiry:

Memberships are activated immediately upon payment, either online or at the branch. Expiry dates are influenced by freeze days, with the Service Provider having the right to extend any additional freeze period as per operations management approval.

Refund Policy and Procedure

A new member has the right to cancel their membership and receive a full refund of the fees within 24 hours of activating their membership, in case they did not receive a free trial day.
Existing returning members are not eligible for refunds upon membership renewal.
Prepaid subscriptions become non-refundable if a cancellation request is submitted after 24 hours. A customer may only waive their subscription in exceptional circumstances, such as permanently relocating to an area where Eighty-Eight services are unavailable, provided they submit supporting documentation. However, no refunds are possible after the 24-hour period.
The refund process may take between 14 to 30 working days to complete.
If paying using a third-party installment service, you must also consider the third party's refund policy and the Eighty-Eight policy regarding subscription assignments and non-refundable payments.
If a member cancels their membership or requests a refund for an unjustified or unacceptable reason, the club management reserves the right to refuse to accept their membership application again for a period of six months to one year.

Note:

The club is not obligated to provide customers with a recipient for membership transfers. The customer requesting the transfer must provide a recipient for the membership.

Membership Freeze Policy

Members are permitted to initiate and activate the freeze on their membership account according to the allocated freeze days, either through the branch or via the mobile application.

1-month membership:

8 freeze days available, which can be used only once free of charge.

3-month membership:

30 freeze days divided into 2 freeze periods. The first period comprises a minimum of 15 days and is provided free of charge. The second period consists of 15 days, and a fee of 30 SAR is applied upon activation. Alternatively, members can opt for a single 30-day freeze period at no cost.

6-month membership:

60 freeze days divided into 3 freeze periods. The initial period lasts for a minimum of 10 days and is provided free of charge. The second period is 20 days and the third period is 30 days, with a fee of 30 SAR applied upon activation of each. Alternatively, members can choose a single 60-day freeze period without charge.

12-month membership:

90 freeze days spread across 6 freeze periods. The first period, lasting at least 15 days, is provided free of charge. Subsequent freeze periods of 15 days each incur a fee of 30 SAR upon activation. Alternatively, members can select a single 90-day freeze period at no additional cost.

Medical Freeze:

In circumstances where a member requests a freeze period due to a medical condition, provided they submit an approved official medical report outlining the details of the condition and the duration of their inability to exercise, the member may be granted the freeze days. These will be deducted as part of the initial freeze period if not already consumed, upon approval from Operations management.

Gym Facility Usage

Eighty-Eight provides shower facilities and lockers for daily use. Members are responsible for their personal possessions. Eighty-Eight may not be held liable for any loss or theft of personal belongings.
Throwing weights on the floor in the weightlifting area or relocating any equipment or accessories outside of the designated workout area or gym is prohibited and may result in membership termination.
After using weights and equipment in the weightlifting and fitness areas, it is imperative to return them to their designated location.
Members are accountable for maintaining gym equipment and property during use. They are obligated to handle all equipment with care and caution, assuming full responsibility for any damage resulting from misuse.
Members are required to utilize all gym equipment and accessories in accordance with recommended guidelines. Any deliberate damage or misuse may lead to termination of membership and incurring additional liabilities.
Photography within the gym premises is strictly prohibited. Eighty-Eight reserves the right to revoke membership privileges accordingly. Furthermore, Eighty-Eight does not accept any legal responsibility for members' distribution of photos or videos on social media or any other platforms.
Prior written consent is required from Eighty-Eight management before utilizing members' photos for promotional activities.
Eighty-Eight Sports Institution and Eighty-Eight gym management retain the legal prerogative to address any content that might adversely affect the company's reputation or its staff, which could result in membership termination or legal ramifications.
Eighty-Eight reserves the right to modify facilities, programs, or operating hours without any liability to members, providing prior notice of any changes. Temporary closures may occur without refunds in cases such as natural disasters, facility maintenance, or government directives.
Members are prohibited from marketing or endorsing dietary supplements, steroids, or any other products to fellow Eighty-Eight members or staff. Selling nutritional or sports subscriptions to members is strictly forbidden and may result in membership termination or legal ramifications.
Providing consultations or advice to fellow members within the gym premises is prohibited. Members are encouraged to seek guidance from certified gym trainers regarding nutrition and physical fitness.
Discussions pertaining to religious or political topics, as well as any verbal or physical criticisms or insults directed towards other members or staff, are strictly prohibited and may result in membership termination.
Members must adhere to all rules and guidelines outlined in these terms and conditions, as well as the code of conduct displayed in the gym.

Service Requester Declaration

The Service Requester acknowledges their capability and willingness to utilize gym facilities, therefore agreeing to abide by health and safety regulations during operational hours. The service requester confirms their physical fitness for participation in fitness activities at their own discretion, releasing Eighty-Eight from any liability for injury or harm while on the gym premises.
Members possess the privilege to transfer their membership to another individual upon payment of a prepaid fee of 150 SAR, with coordination between the parties facilitated by Eighty-Eight acting as an intermediary. Any member acquiring a subscription from another member must consent to the existing terms and conditions.
The Service Requester grants permission for Eighty-Eight management to verify the accuracy of their personal data through a third party / external entities for the purpose of verifying personal information.

Service Provider Rights and Limitation of Liability

The service provider does not offer warranties or guarantees regarding facility usage and shall not be held responsible for any loss or damage suffered by the service requester.
The service provider retains the right to modify Website / Mobile application content, issue announcements, remove content, suspend accounts, and amend terms and conditions as deemed necessary.

The service provider does not offer any guarantees or assurances concerning facility usage and shall not be accountable for any loss or damage experienced by the participant.
Eighty-Eight Sports Institution / Eighty-Eight gym bears no responsibility for any delay or inability to fulfill these terms due to circumstances beyond its control, without any fault or negligence on its part. Such circumstances may encompass, but are not confined to, acts of civil or military authorities, prevailing laws and regulations, epidemics, wars, fires, explosions, natural disasters, electronic piracy, or other unlawful activities.

Guarantees

The member commits to compensate and is legally accountable for any damages suffered by the service provider resulting from breaches of terms, negligence, or any legal actions or claims. The member acknowledges accountability for actions carried out through their accounts or associated companies that may affect Eighty-Eight Sports Institution / Eighty-Eight gyms and its representatives.

Member Data Preservation

The service provider assures the preservation and appropriate use of member data for purposes directly related to the business operations at Eighty-Eight Sports Institution / Eighty-Eight Gyms.

Notifications

Parties will communicate through various activated channels, such as in-branch, email, calls, and social media.
Members are encouraged to share feedback or lodge complaints through the branch, or any other available channel provided by the service provider.

Value Added Tax Terms

Members agree to receive simplified tax invoices electronically.

Applicable Law and Jurisdiction

These terms are subject to the laws and regulations of the Kingdom of Saudi Arabia.

General Provisions

The approved language for these terms and conditions is Arabic. In case of any discrepancies, the Arabic version will prevail. All statements, undertakings, and guarantees in the terms are directed to the Service Requester.

Acceptance and Signature

The service requester acknowledges having read the terms and conditions stated and agrees to it.
